Top jockey Tommy Berry is set to front Racing NSW stewards after being issued with five charges in relation to accepting a "consideration" without permission, and for the illegal use of a mobile phone on a racecourse.

The charges were issued by Racing NSW stewards this week following an investigation which also involved registered owner and punter Zaid Miller.

Two of the charges against Berry have been issued under rule AR115 which states a jockey must not "accept or agree to accept any money, gift or other consideration in connection with a horse in a race without the consent of the stewards and his or her nominator".

The charges relate to races between March 24 and March 30 this year.

Berry has also been asked to answer charges relating to the possession and use of a mobile phone on a racecourse between October 2021 and September 2022, along with engaging in behaviour prejudicial to the "image, interests, integrity or welfare of racing by providing tips and accepting a consideration from Zaid Miller".

Miller's charges relate to engaging in conduct which led to Berry breaching the rules of racing and in activity prejudicial to the interests of racing.

The stewards have also issued charges against jockeys Jordan Mallyon and Jack Martin for betting on races and Kayla Nisbet for accepting money from professional punter Jacob Hoffman in relation to a horse in a race.

Hoffman has also been asked to answer eight charges, four of them in relation to Martin and Nisbet.

A date for the hearings is yet to determined.
